Why do land boundaries sometimes conflict? Most often, boundary disputes arise after confusing legal descriptions cause two landowners to lay claim to the same tract of land. The deeds in question may actually describe the same area of land, or a confusing description may simply cause two landowners without an adequate background in reading such descriptions to believe that the land is theirs. Faulty legal descriptions may have been written and recorded by people lacking proper qualifications, such as laypeople without surveying experience.

Many such cases arose in the history of the United States, particularly when land was granted by European government officials who had not actually visited North America and were relying on inaccurate maps. In addition, historical methods of land surveying, such as the metes and bounds system, relied on monuments likely to change over time, such as trees. Up until 2006, it had been 30 years since the Florida Supreme Court was faced with a case about eminent domain for private development. It had never been an issue until development firm “Viking Inlet Harbor Properties” combined forces with the now former, Riviera Beach, Mayor Michael Brown to exploit and capitalize on this century old property law.

The Viking group had already sunk $50 million into the acquisition of property, engineering and planning fees for a proposed $2.4 billion project that would reface the marina district with luxury condominiums, single-family homes, hotels, offices, shops and yachting facilities. This undertaking would transform 400 acres of waterfront property in one of the poorest cities in Palm Beach County into a veritable country club, but not without a price. In order to complete the project about 1,700 homes had to be removed, and about 5,100 residents would be forced to sell their homes and relocate. For investors in UK buy to let properties, the sort of mortgage that they take out can have considerable implications on how much tax they will pay, both over the life of the investment and only a monthly basis. This can significantly impact total returns from buy to let investing. Unfortunately there is no single choice of mortgage that is right for every property investment strategy so prospective landlords should investigate their options with great care.

The first choice to make is between an interest only mortgage and one that includes repayment of the principal amount owed. Traditionally most buy to let mortgages have been interest only ones. This is because the interest paid can be deducted from the rent received for income tax purposes. Thus many landlords have wished to minimize tax by not reducing the loan amount. The main tax that would then be payable is capital gains but this is levied at a lower rate than income tax. The Mira Costa section of Manhattan Beach is one of several areas in the South Bay that have seen an increase in the number of single family homes sold in 2009 from 2008. Yet at the same time, the median sales price dropped by 20 percent from the previous year.

What is interesting about this is that the median sales prices for the years 2006 through 2008 were within striking distance of each other and so the 20 percent drop in price more or less represents the decline in value from the peak year of 2006. The current median sales price is $1.35 M, up significantly from the beginning of the decade when it was $835 K. Given that there are only a handful of single family homes in escrow at this writing and that the current active inventory is just 10, this new year is off to a timid start. (more…)
